General Terms and Conditions


Contracting Parties: 
The contracting parties are Apartments Wallas and the guest. If a third party has placed an order on behalf of the guest, then the third party in question together with the guest is liable to Apartments Wallas for all the obligations under the contract based on a joint guarantee.

Conclusion of the Contract:
The contract is concluded when Apartments Wallas has either sent the confirmation of reservation or the confirmation of the deposit payment to the guest or when guest has paid for the accommodation directly or indirectly to Apartments Wallas. This means that the guest has fully accepted the General Terms and Conditions.

Reservations: 
The guest can make a reservation in writing by emailing welcome@bovecapartments.com, by phone +386 64 227 187 or in person at the reception of Apartments Wallas. The guest can also make a reservation through a website www.bovecapartments.com. In the event of a reservation through the website's reservation form, the guest agrees to the reservation-related terms and conditions of the website and consequently also to the general terms and conditions of Apartments Wallas.

Reservation Cancellation or Change: 
If the guest would like to change the reservation or cancel it, they can contact Apartments Wallas by writing an email to welcome@bovecapartments.com or by calling +386 64 227 187.

General Terms and Conditions of Cancellation: 
The following cancellation-related terms and conditions apply for reservations through www.bovecapartments.com:
cancellation up to 15 days before arrival: no cancellation fees charged,
cancellation 14 - 0 days before arrival: 100% of the total price charged;
In the event of early departure, the remaining accommodation days must be paid in full.

No-show:
If the guest fails to check in at Apartments Wallas on the day of scheduled arrival, they will be charged according to the cancellation-related terms and conditions.

Payment:
The following payment methods are available: cash upon arrival or a bank transfer. The following prepayment method is available: bank transfer.

Prices:
All the listed prices are in Euro (€ / EUR) and include the VAT, but exclude the city tax (2€ per adult per night and 1€ for children 7-18yrs per night). The price includes the following: accommodation, wireless internet connection, free parking space for one vehicle per unit, baby cot, clean bed linen, two towels per person and final cleaning.

Check-in / Check-out:
Check-in: 3:00 pm- 11:59 pm, check-out: 6:00 am- 10:00 am.

Check-in:
For security reasons, guests are required to present a valid identity document (an identity card or a passport) at the time of check-in.

City Tax: 
The city tax is charged to all visitors under the following conditions imposed by the Municipality of Bovec. Adult visitors are charged a city tax in the amount of € 2 per person per night. Children and youths between 7 and 18 years of age pay half the value of the imposed city tax, i.e. a city tax in the amount of € 1 per person per night. Children 0-6 years old don't pay the city tax.

Baby crib (cot) for an infant (0-2 years old):

The baby crib (cot), including fresh linen and towel, is available in all apartments completely free of charge.

Pets: 
Pets are not allowed.

Smoking:
Smoking in the indoor areas is strictly prohibited. Smoking inside the house with an open window is also strictly prohibited. The guest will be charged for any caused damage as well as additional cleaning. Thus, guests are welcomed to smoke outside the house.

Parking Facilities: 
An outdoor car park for one vehicle per unit is available to guests free of charge. Apartments Wallas accepts no liability for vehicle safety, any damage to vehicles or the objects stored in the vehicles.

Limitation of Liability:

Apartments Wallas shall not be liable to the Guest for any loss or damage, direct or indirect, to its property, or person, however caused arising from the Stay (other than any personal injury caused to the Guest arising directly from the gross negligence of Apartments Wallas). Apartments Wallas’s total liability shall not exceed the value of the contract. Nothing contained in the contract or in any other document referred to or incorporated in it shall be read or construed as excluding any liability for death or personal injury caused by Apartments Wallas’s negligence or liability for fraud or fraudulent misrepresentation. BBQ use is at guests’ own risk. Apartments Wallas is not liable for activities that were recommended to the guests by Apartments Wallas staff, before, between or after their stay at Apartments Wallas.

Damage:
Apartments Wallas reserves the right, and is authorized to do so by the guest’s acceptance of General terms and conditions upon apartment reservation, to charge for any damage caused to the guest’s room or Apartments Wallas during the guest’s stay at the Apartments Wallas, or for any items that are missing at the time the guest leaves the apartment. Upon departure the guest is obliged to inform the staff about the damage in the apartment or in the apartment building.

Early Departure from the apartment:
Apartments Wallas is not obliged to refund the guest/the customer the cost of an overnight stay in the event of early departure. Apartments Wallas management’s approval is required for possible exceptions to this depending on the reason for early departure.

Governing Law

These General terms and Conditions shall be governed by Slovenian law and the parties agree to the exclusive jurisdiction of the Court in Koper. If not specified in the Terms and Conditions above, the general Terms and Conditions of the “uzance v gostinstvu in turizmu” apply.

Privacy Protection: 

Apartments Wallas shall protect all the acquired guest-related data in accordance with the Personal Data Protection Act. By accepting the offer, the guest agrees to the use of the data for the purposes of statistical processing and notification of Apartments Wallas deals. At the time of check-in, the guests are required to present their respective personal documents.

Content published on the website may only be reproduced for non-commercial purposes, and shall contain all copyright warning notices and must not be transcribed, reproduced or otherwise disseminated without the permission of the Apartments Wallas. We strive to publish only accurate and updated information on the website, but we cannot guarantee the complete accuracy and reliability of all published information. We assume no responsibility for the possible consequences arising from the use of information published on this website or the temporary interruption of the website. The Apartments Wallas reserves the right to change any information published on this website. By using this website, the visitor confirms to accept these terms and conditions in full and to agree with them.

Data protection

(1) Personal data: We understand the importance of privacy of our website visitors. Therefore, all the data that we collect on the website (online form), will be used exclusively for the purposes for which they were collected.

(2) Data retention: Personal data collected on the basis of your explicit consent is stored in an electronic or physical database of personal data (depending on the form of the acquired personal data). Databases are adequately protected by technical means, and only authorized persons have access to them. All personal data that you provide to us digitally (online form) is stored on servers within the company or partners with whom we have concluded contracts. The collected personal data that fall under the General Data Protection Regulation will be retained for up to 30 days from the moment you notify us that you no longer agree with the retention and processing of your personal data. If we wish to use your personal data you have provided to us for new or different purposes, other than for which it was originally collected, we will request your consent first. All personal data will be kept confidential.

(3) Collection, processing and use of personal data: We collect, manage, and process your personal data only for statutory purposes or on the basis of your explicit consent. Personal data that we need to collect for statutory (or contractual) purposes are for example:

Data obtained by consent is primarily intended for communication with individuals, in order to inform them about the activities of the Apartments Wallas. We shall not transfer the collected personal data to third parties, without the previous consent of the owner.

(4) Use of personal data: We only collect and process personal data that we need for the performance of services or that are requested by law or contract or those for which you granted explicit consent. For example, such personal data is: name and surname, address, telephone number, e-mail address, date of birth. The use of your data for e-mail notification purposes shall be effected only after your consent or on the basis of a legitimate interest. For e-mail notification purposes, we collect: e-mail address (obligatory), name (optional), surname (optional).

(5) Withdrawal of consent: You can withdraw the consent to process personal data at any time. You can withdraw the consent for a particular purpose or for all purposes of processing personal data with which you have agreed. You can withdraw the granted consent by answering to an e-mail, by sending an e-mail at welcome@bovecapartments.com subject: Unsubscribe. In case of withdrawal of the consent to collect or process personal data, all collected personal data to which the request for deletion refers will be deleted or excluded from automatic processing. The withdrawal of consent to the processing of personal data does not affect the legality of the processing of personal data relating to you effected until your withdrawal nor the use of such personal data for statutory purposes.

(6) Individual's rights: Every individual subscribed to the newsletter has the:

- Right of access,

- Right to object,

- Right to rectification,

- Right to be forgotten,

- Right to data portability,

- Right to restriction of processing and retention or right to withdraw the consent for processing and retention, without prejudice to the lawfulness of the processing which was, on the basis of consent or approval, carried out until its withdrawal.

(7) Data protection: We have taken technical and organizational measures to protect your personal data. Our methods and safety measures are regularly adapted to the latest standards and modern technologies. If the protection of your personal data is compromised, and if this would indicate that such a threat to the protection of personal data could pose a great risk to your rights and freedoms, we will notify you immediately. In the case of a personal data breach, we shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach to the competent supervisory authority.

(8) Right to object: If you believe that we have violated your rights in any way, you may submit an application for clarification to the Apartments Wallas or the competent supervisory authority - the Information Commissioner of the Republic of Slovenia: Republic of Slovenia, Information Commissioner, Zaloška 59, 1000 Ljubljana, Slovenia, www.ip-rs.si, at any time.

(9) Important notice: We commit ourselves to process all collected data only in the context of the aforementioned management purposes or to process all personal data and in accordance with the Personal Data Protection Act and other relevant sector legislation as well as in accordance with the Regulation (EU) 2016/679 on the Protection of Individuals with regard to the Processing of Personal Data (GDPR).
